This is a motion for summary-judgment pursuant to rule 113 of the Rules of Civil Practice. The plaintiff seeks to recover an unearned insurance premium based on an alleged cancellation by the plaintiff, the loss payee, named in a policy of insurance issued by the defendant to one Oppie Johnson. Oppie Johnson had purchased a motor vehicle from the plaintiff’s assignor and executed a chattel mortgage to it as part of the purchase price.
