On October 30, 1961, the day set for his trial on the charge of rape, petitioner filed a motion for continuance and an affidavit in which he alleged that he was and for a long time had been impotent and that he needed time *58to gather medical evidence including medical reports in connection with injuries he suffered in 1953 and 1954.
