BLACKBIRD, Justice.

This action was instituted by defendant in error, as plaintiff, against plaintiff in error, as defendant, to quiet her title to 40 acres of land described as: The 5½ of the Ni/2 of the NWy4 of Sec. 21, Twp. 7 N-, Rge. 1 E., in Logan County, Oklahoma. Said defendant sought by cross-petition to obtain specific performance of a contract plaintiff allegedly entered into with him to sell him. an undivided one-eighth or “five-acre” oil royalty interest in said tract. Reference to the parties by their trial court designations will be continued.
