This is an action to recover damages for personal injuries brought by defendant in error, Harry Kirschner, against his son, Morris Kirschner, plaintiff in error. The parties will be referred to as in the trial court.

Plaintiff alleges, in substance, that on the 9th day of October. 1929, at the invitation or suggestion of defendant, plaintiff became the guest of defendant as a passenger in an automobile from Tulsa to Wewoka, through Okmulgee.
