Elliot, a citizen and taxpayer of the city of Philadelphia, in his own behalf and in behalf of such other citizens and taxpayers as may join, v. City of Philadelphia and John E. The plaintiff, a resident taxpayer of the city of Philadelphia, seeks to enjoin the municipal authorities from making a loan authorized by ordinance for certain city purposes. The objections relate primarily to constitutional questions and for the purpose of this case may be discussed in a few general propositions. It is contended that the city has exhausted its borrowing capacity and by reason thereof cannot increase its indebtedness to the amount authorized by the proposed new loan.
