NOONAN, District Judge.

This case was tried before the court sitting without a jury. The evidence presented consists of two printed stipulations marked plaintiffs’ exhibits Nos. 1 and 2 respectively.

Plaintiffs’ exhibit No. 1 is a 179 page stipulation and an exhibit annexed thereto, which exhibit is conceded to be a true •copy of the Last Will and Testament of the decedent.
