DIMOND, Justice.

Neither appellant nor his client appeared in the district court on October 21, 1965 at 2:00 P.M., the time set for the trial of the case of City of Fairbanks v. Spyros Man-olia. On that same day the district court issued an order to show cause directed to appellant which stated:
