MEMORANDUM & ORDER

SHAPIRO, Senior District Judge.

Plaintiff, Synergetics, Inc. (“Synerget-ics”), filed an action for patent infringement against defendants, Peregrine Surgical, Ltd. (“Peregrine”) and Innovatech Surgical, Inc. (“Innovatech”) (collectively “defendants”). Jurisdiction is conferred upon this court by 28 U.S.C. § 1331 and § 1338(a).

All parties are companies involved in the design, manufacturer and sale of ophthalmic equipment for use in eye surgery, including an adapter that connects a mi-crosurgical optic fiber instrument, or laser probe, to a light source. Synergetics alleges…
