SUMMARY ORDER
Plaintiff-Appellant Seneca Beverage Corporation (“Seneca”) appeals the judgment of the District Court for the Western District of New York (Charles J. Siragusa Judge), granting summary judgment in favor of defendant HealthNow New York, Inc. (“HealthNow”) and dismissing Seneca’s claims under the Employment Retirement Income Security Act (“ERISA”), 29 U.S.C. §§ 1001 et. seq., and for breach of contract. For the following reasons, we affirm the District Court’s dismissal of Seneca’s ERISA claim, but we reverse and remand for further proceedings with respect to the District Court’s…
