Plaintiff had a verdict by direction, with exceptions ordered to be heard in the first instance at the Appellate Division.'

The complaint alleged that on or.about July 21, 1894, the plaintiff and defendants entered into an agreement in writing and under seal, whereby the defendants jointly and severally promised and agreed to purchase from plaintiff on May 1,1900, or on such eai'lier *455day as defendants might elect, 250 shares of the preferred capital stock of the Waterbury and Marshall Company, a corporation, and to pay therefor the sum of $25,000, with interest at six per cent per.…
