This matter is before the court on a motion for summary judgment filed by Riv-ergate Executive Park, Ltd. (hereinafter referred to as “defendant”). The controversy concerns whether the defendant paid sufficient Tennessee privilege taxes to secure its $517,785 claim against property formerly owned by the debtor. Upon consideration of the stipulations, statement of counsel and the entire record, this court concludes that the defendant has a secured interest against property formerly owned by the debtor in the amount of $421,526.
