On September 5,1916, appellee (plaintiff below) delivered to appellant (defendant below) at Bowling Oreen, Kentucky, one car load of live stock to be skipped to tbe Bourbon Stock Yards in Louisville, Kentucky, wbicb defendant, as a common carrier, agreed and undertook to do. The consignment consisted of one hundred and nine hogs, five head of cattle and twenty-seven sheep and goats, the latter occupying an upper tier in the car, which had been constructed .for that purpose.
