Candler, Justice.

On July 9, 1857, William Brannen executed and delivered to A. B. Riggs a deed purporting to convey a tract of land and flowage rights. The deed was recorded in Bulloch County on June 17, 1867. It was captioned “Georgia, Bulloch County,” and recited that the grantor had for a consideration of $100 sold and conveyed to the grantee, his heirs and assigns, “all the land belonging to said William Brannen which the said A. B. Riggs may be able to overflow with water or damage with water by making a dam across Greate Lotts Creek at or near the Riggs bridge for the purpose of a mill,…
