Frank Blumhoff, plaintiff in, error, defendant in the trial court, was a farmer who lived in the same neighborhood with and near the farm of the complaining witness, J. T. McFatridge. Both men had horses which were allowed to run at large. About the 18th day of February, 1922, a three-year old black Percheron horse was missed by the complaining witness. The proof offered by the state indicates that this horse was found in the possession of the defendant, and recovered from him about three weeks later.
