The plaintiff in error, hereinafter called defendant, was convicted in the district court of Osage county on a charge of burglary and was sentenced to serve a term of seven years in the state penitentiary.

On the night of September IT, 1925, the store of Porter Williams at Burbank, Okla., was broken into and merchandise consisting of ladies’ coats, dresses, furs, and men’s hose, suits, gloves, shirts, and leather coats, of a total value of about $2,500, w'as stolen therefrom.
