In 1907 Ernest M. Valentine and William C. Phillips were the owners of a school-land lease of a tract of land in Scott’s Bluff county and were in possession of the land under the lease, and in March of that year they leased the land in question to the plaintiff Frank Chalupa for one year from March' 1.
