The defendant has filed a motion under 28 U.S.C. § 2255 to vacate, set aside, or correct his previously imposed sentence for (1) distribution of cocaine and (2) conspiracy to distribute and possess with intent to distribute cocaine in violation of 21 U.S.C. §§ 841 & 846. He also has moved to proceed in forma pauperis. The § 2255 motion is currently before the court for initial review pursuant to Rule 4, Rules Governing Section 2255 Proceedings in the United States District Courts.
