VINSON, District Judge.

Pending are cross-motions for summary judgment. (Docs. 8, 9). For the reasons set forth herein, the plaintiffs’ motion is DENIED, and the defendant’s motion is GRANTED.

I. BACKGROUND

This is an action for a refund of income taxes paid on money received in settlement of an employment discrimination lawsuit. The plaintiffs, Chester J. and Gunda P. Mal-eszewski, paid federal income tax on an award they received as settlement of an age discrimination claim and; after their request for refund was denied by the defendant, brought this action.
