Appeal from a decree of the Circuit Court of Scott county. Decree for defendants. Complainants appeal.

This suit involves the question of whether Nancy E. Mann, the surety on the bond of D. H. Mann, as *631guardian of the appellant, plaintiff in the court below, is liable for an item of eight hundred dollars received by such guardian, which sum was paid to him in 1907 by a certain railway company in certain condemnation proceedings in Scott county, under statute in Virginia, wherein certain land of his ward, the plaintiff, was taken by the railway company.

The guardian’s bond was given in Wise county in 1902, and is in the words and figures following: “Know all men by these presents:
