MELLOTT, Chief Judge.

By appropriate pleadings, plaintiff, a corporation engaged in operating a public licensed grain warehouse and elevator at Niles, Kansas, sought judgment against the Commodity Credit Corporation for $37,202.62, The issues raised in the pleadings are hereinafter summarized in a memorandum findings of fact and conclusions of law previously entered herein. The memorandum, in-*790eluding a brief discussion of some of the issues of law, is now set out:
