Scartozzi appeals from so much of a judgment of the Supreme Court, Suffolk County (Whelan, J.), dated May 14, 2008, as, upon so much of an order of the same court dated February 2, 2005, as denied her motion for summary judgment on the first and fourth causes of action, and upon so much of an order of the same court dated February 22, 2008, as granted that branch of the defendants’ motion which was for summary judgment dismissing the complaint insofar as asserted by her, is in favor of the defendants…
