Tliis action was brought by appellee to recover damages by reason of the killing and maiming of a nunffier of appellee’s cattle, on the track of appellant’s railroad, it being alleged that the cattle were so killed and injured in consequence of the negligent operation of one of appellant’s trains. The trial was before the court and a jury, and resulted in a verdict for the plaintiff, upon which the court subsequently gave judgment.
