Appeal from a judgment of the County Court of Chemung County (Buckley, J.), rendered December 5, 2008, convicting defendant following a nonjury trial of the crime of aggravated harassment in the second degree.

In October 2006, defendant was charged in a felony complaint with a single count of rape in the first degree stemming from conduct that allegedly involved a then 10-year-old child and occurred in November 2000.
