This personal injury diversity suit is before us a second time. It was originally filed against the manufacturer and the assembler of a grenade which exploded prematurely, injuring two United States servicemen. In McGonigal v. Gearhart Industries, 788 F.2d 321 (5th Cir.1986) (“McGonigal I”), we reversed a directed verdict in favor of the assembler, and remanded for a new trial based on negligence. The jury in the second trial found the assembler negligent, and judgment was awarded in favor of the injured servicemen. The assembler now appeals to this Court…
