Petitioner, James R. Tully, appeals from the trial court’s denial of his petition for a writ of habeas corpus. The facts are not in dispute.

On December 5, 1967, petitioner was arraigned in the court of the Hon. William Hoar, Judge of the Seattle District Justice Court of Seattle, King County, Washington. A preliminary hearing was scheduled on December 14, 1967. Prior thereto, petitioner, through his father, retained counsel for the petitioner.
