J. H. Smith brought a suit in a justice’s court of Bryan County against the Seaboard Air-Line Bailway for $30, for the killing of “one sandy yellow heifer cow, two and one half years old.” Upon the trial before the jury, Smith testified, that he owned “a sandy yellow heifer which was killed by the Seaboard.” 'The animal was not killed outright, but was so badly crippled that it was of no use.
