The facts in this case are as follows: On June 17,1876, the Perpetual Building and Saving Association recovered in the district court of Atchison county a judgment against John P. and Matilda W. Hummer for the sum of $321.08, bearing interest at nine per cent, per annum. June 6, 1881, an execution was issued upon this judgment, which was returned wholly unsatisfied as to the Building and Saving Association.
