On January 14, 1994, plaintiff, Richmond Petroleum, Inc. (Richmond), filed a complaint pursuant to provisions of the State Administrative Procedure Act (APA), § 24-4-101, et seq., C.R.S. (1988 Repl.Vol. 10A), seeking judicial review of an order of the Colorado Oil and Gas Conservation Commission (com mission). The trial court dismissed the complaint for lack of subject matter jurisdiction on the ground that the complaint was filed one day late.
