BERNSTEIN, Justice.
This is an automobile accident case. Joel F. Wells, appellant herein, brought an action against Tanner Brothers Contracting ■Company (hereafter referred to as Tanner), appellee, to recover damages for per•sonal injuries sustained by him as a result ■of the alleged negligence of the appellee. A previous trial resulted in a jury verdict ■of $30,000 for Mr. Wells but the trial court .granted a motion for a new trial to Tanner.
