MARSH, District Judge.
Plaintiff, Smeltzer, a citizen of Pennsylvania, brings this action against the defendant, Deere and Company, a Delaware corporation, alleging that in June, 1964, while operating a tractor near Ford City, Pennsylvania, he sustained personal injuries as the result of a brake failure stemming from the defendant’s negligence and “breach of the implied warranty of fitness” with respect to the manufacture of such tractor.
