FLANIGAN, Judge.
Plaintiff-respondent, Julia Davis, brought this action in the Circuit Court of Butler County against defendant Richard Allen, seeking damages for personal injuries allegedly sustained by plaintiff arising out of a collision between a car operated by Allen and a car operated by plaintiffs father. Allen filed a third party petition against State Farm Mutual Automobile Insurance Company, third party defendant-appellant. Thereafter, Allen failed to file a timely answer.
