Appeal from Van Burén; Des Voignes (L. Burget), J. Bill by O. A. Gould, executor of the estate of Polly Shearer, deceased, against T.. Harley and another for the construction of a lease. From a decree dismissing the bill, plaintiff appeals.

The bill of complaint herein was filed to obtain the construction of a certain lease, and praying for its discharge from record. On January 12, 1898, Polly Shearer (now deceased) leased to the defendants! certain land on Sister Lakes, Van Burén county, by a written lease duly signed, witnessed and acknowledged. This lease was duly recorded in the office of the register of deeds for said county. The lease, among other things, contained the following provision:
“The said party of the first part, in consideration of the rents and covenants herein specified, does hereby let and, lease to' the said…
