Appeal from a judgment of the superior court for King county, Morris, J., entered February 19, 1906, upon findings in favor of the plaintiff, after a trial on the merits before the court without a jury, in an action to determine the beneficiary under a policy of life insurance.

This action was brought by the plaintiff, claiming to be the beneficiary under a policy of insurance, issued by the Modern Brotherhood of America, upon the life of Elma B. Martin, deceased. The defendant, Malcolm Everett Martin, a minor son of the deceased, controverted the claim of the plaintiff, and claimed to be the sole beneficiary under the policy of insurance. This was the issue in the case. The trial court found in favor of the plaintiff. The defendant Malcolm Everett Martin appeals.
