MEMORANDUM DECISION AND ORDER
KIMBALL, District Judge.
This matter is before the court on Defendants Uintah Special Services District and the Uintah Special Services District Administrative Control Board’s (collectively “USSD”) Motion to Dismiss and Defendants Uintah County, Uintah County Commission, and Lloyd Swain’s (collectively “Uintah County”) Motion to Dismiss.
