Mr. Presiding Judge Smedley,

of the Commission of Appeals, delivered the opinion for the Court.

Defendant in error, the Town of Refugio, sued plaintiffs in error for the title and possession of 43.9 acres of land within the bounds of the four leagues granted by Coahuila and Texas to the town and upon which the townsite is situated. The area involved in the suit, except a tract of 5.28 acres, is a part of the bed of Mission River which runs nearly through the center of the four league grant, crossing its west and south lines.
