Before the court is defendant’s motion to dismiss the complaint, or in the alternative for summary judgment, and memoranda in support thereof and opposition thereto. The basis of defendant’s motion is that, as a duly appointed and authorized probation officer, he enjoys absolute quasi-judicial immunity for the investigation and preparation of a presentence report pursuant to a sentencing judge’s request.
