From Delaware Circuit Court; Joseph G. Leffler, Judge. Action by William F. Petty, as executor of the will of Thomas Petty, deceased, against the Federal Life Insurance Company and the Model Life Insurance Company. From a judgment for plaintiff, the defendant Federal Life Insurance Company appeals. (Transferred from the Appellate Court under §1405 Bums 1908, Acts 1901 p. 590.)

Suit by appellee against appellant and the Model Life Insurance Company, on a life insurance policy dated May 22, 1900, issued by the Model Life Insurance Company on the life of Thomas W. Petty, for $2,500, payable to his legal representative, and on a policy of reinsurance, issued to said Petty, by appellant, dated March 12, 1904.

The complaint alleges that on March 12, 1904, the Model Life Insurance Company and appellant entered into an agreement, by the terms of which appellant reinsured and assumed all policies of the Model company, including the one sued on, and thereafter, on April 28,…
