On October 28, 1998, appellant was convicted of rape, in violation of Article 120, Uniform Code of Military Justice, 10 USC § 920, at a trial before a general court-martial consisting of a judge alone at K.I. Sawyer Air Force Base, Michigan. He was sentenced to a bad-conduct discharge, confinement for 7 years, and reduction to E-l. The convening authority approved the sentence, except for confinement exceeding 66 months.
