The complaint in this case was demurred to for insufficiency, because it did not state facts constituting a cause of action. Several objections are taken to the complaint, all of which we deem untenable.

In the first place, it is insisted that it dpes not appear that the officers of the school board of the city of Milwaukee had *491any power or authority to make and execute tbe orders mentioned in tbe complaint, nor to do tbe acts it is .they have done.
