This matter is before us on application for a writ of prohibition upon the relation of E. Augustus Heinze. The petitioner complains that the district court of the second judicial district is about to strike his answer from the files of a certain cause pending in said court, wherein the Boston and Montana Consolidated Copper and Silver Mining Company, plaintiff, sues him for a large sum of money.
