This was an action of trespass, brought by appellee, before a justice of the peace, against appellants, to recover damages claimed to have been sustained by the trespass of appellants’ cattle upon appellee’s premises. A trial before the justice of the peace resulted in a judgment in favor of plaintiffs for $24 and costs. The case was removed by appeal to the circuit court of LaSalle county, where a trial was again had by the court, by consent of the parties, without a jury, which resulted in a like judgment as that rendered by the justice, and the ease is appealed to this court.
