Plaintiff and defendant were married at Alexandria, Virginia, on July 3, 1939, and resided together as husband and wife until on or about July 9, 1952. In 1938 defendant’s wife by a former marriage, Helen Elizabeth Powell, brought an action for divorce against defendant. The case was tried before the Hon. John V. Maloney, Justice of the Supreme Court, who signed an interlocutory decree of divorce on the 29th day of December, 1938, which decree provided that the same should become the final judgment as of course three months after the filing thereof.
