THE COURT.

This is an appeal by the plaintiffs from a judgment partially in their favor in an action to establish their right and title in and to the whole of certain first mortgage certificates issued by the defendant Mortgage Guarantee Company.

Each of the certificates represented a face value of $5,000, bearing interest at six per cent. One thereof, dated July 1, 1924, was issued to “Abbie S. Williams and Mount Holyoke College of South Hadley, Mass.”, and the other, dated June 1, 1926, was issued to “Abbie S.
