Tbe plaintiff in tbe trial court, as administrator of tbe estate of Nelse C. Nelson, deceased, recovered judgment against tbe defendant in an action wherein it was claimed that tbe death of tbe deceased was caused by tbe negligent acts of tbe defendant. Tbe defendant prosecutes error, *250and one of the grounds of complaint is that the verdict and judgment are not sustained by the evidence.
