At the June term, 1898, of the criminal court of Jackson county, the defendant was convicted'of murder in the second degree and his punishment fixed at ten years’ imprisonment in the penitentiary, for having theretofore, at said county, shot to death with a double-barrel shotgun, one Joseph W.
