Appellant instituted tbis action against Edward *348Aubry as city controller of the city of Hammond to compel the latter, by writ of mandate, to issue a warrant on the treasurer of said city’in appellant’s favor for $972.50, alleged to be due from said city under a contract for the construction of a cement sidewalk.
