Appeal by the defendant, Stephen A. Donlon, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of Kings on the 21st day of December, 1911, upon the decision of the court, rendered after a trial at the Kings County Special Term, setting aside a deed of real property.

Woodward, J.:
The plaintiffs are the sons and daughter of the defendant, and they bring this action to have adjudged as void a certain deed made by one Johanna Donlon, their mother, to Stephen A. Donlon. This deed bears date of March 8, 1910, and Johanna Donlon died on the tenth day of March in the same year, being survived by the defendant and the plaintiffs in this action, the latter being her only heirs at law and next of kin.
