Appeal from an order of the Court of Claims (Collins, J.), entered August 10, 2015, which, among other things, granted defendant’s motion for summary judgment dismissing the claim.

In 2008, claimant was convicted of various crimes and sentenced to an aggregate prison term of 30 years. Although claimant’s convictions were affirmed on appeal, it was determined, on the People’s cross appeal, that claimant should have been sentenced as a predicate violent felony offender and the matter was remitted for resentencing (People v Jackson, 65 AD3d 1164 [2009], lv denied 13 NY3d 939 [2010]).
