International Paper Co. (hereinafter IPC) appeals from a judgment entered in the District Court for .the Eastern District of Arkansas 1 awarding Missouri Pacific Railroad Co. (hereinafter the Railroad) $11,-329.44 plus interest and costs under the indemnity provisions of an industrial sidetrack agreement. For reversal IPC argues the district court erroneously failed to (1) require the Railroad to prove negligence on the part of IPC as a condition of recovery under the indemnity agreement, (2) require the Railroad to prove its legal liability to the injured employee,…
