REGAN, Judge.

Plaintiff, George E. Reine, Jr., as the vendee, instituted this suit for specific performance of a contract to purchase and sell real estate and alternatively for damages for breach thereof and for cancellation of a lis pendens, against the defendants, Lawrence T. Kirn, Sr., Dr. Theo. F. Kirn, who signed the agreement as vendors, and Mrs. Jacqueline Richardson, widow of Lawrence T.
